Allahabad High Court

SURAJPAL SINGHversusATUL VATS, DISTRICT MAGISTRATE

Decided

Holding

The contempt application is consigned to the record, allowing the applicant to contest the order before the appropriate forum.

Summary

The applicant, Surajpal Singh, filed a contempt petition alleging that the District Magistrate, Atul Vats, failed to comply with an order dated 18 February 2026 issued in Criminal Misc. Writ Petition No. 27316 of 2025, which required the magistrate to consider the applicant's application. The court examined the petition and noted that the instructions dated 7 August 2026, produced by the respondent, were not disputed by the applicant. The court directed that a copy of these instructions be served on the applicant's counsel. Since the applicant has not yet challenged the order before the appropriate forum, the court consigned the contempt application to the record, leaving it open for future questioning. The instructions were taken on record as Appendix‑A.
