Allahabad High Court

BHEEM SINGHversusHARENDRA KUMAR, DIVISIONAL FOREST OFFICER SOCIAL FORESTRY VAN PRABHAG AND ANOTHER

Decided

Holding

The contempt application was dismissed as infructuous because the order granting the minimum pay‑scale had been issued and the applicant was prepared to comply.

Summary

The applicant, Bheem Singh, filed a civil contempt application against the Divisional Forest Officer, Harendra Kumar, alleging non‑compliance with an order granting a minimum pay‑scale of Rs.18,000. The Additional Advocate General informed the court that the DFO had already issued the order on 5 January 2026 and the applicant had been asked to join immediately. The applicant’s counsel confirmed that the order was received the previous evening and the applicant would join soon. Considering that the order had been passed and the applicant was willing to comply, the court held that the contempt application was no longer viable. Consequently, the contempt notice was discharged and the application dismissed.
