Allahabad High Court

SMT SUMAYLAversusANKITA SHARMA, SENIOR SUPERINTENDETN OF POLICE, AND ANOTHER

Decided

Holding

The writ order was substantially complied with, so the contempt application was dismissed.

Summary

The applicant, Smt Sumayla, filed a contempt application alleging that the respondent, Senior Superintendent of Police Ankita Sharma, had failed to comply with a writ order dated 04.12.2014 in Civil Misc. Writ Petition No. 52588 of 2014 (Razeena Bano v. State of U.P.). The learned counsel for the applicant submitted that compliance was achieved by the lodging of FIR No. 0445 of 2026 on 02.09.2026 under Section 70(1) of the BNS, 2023, and later produced additional instructions and FIR No. 0164 of 2026 dated 31.07.2026. The Court examined the documents and found that the writ order had been substantially complied with. Consequently, the contempt application was consigned to the record, effectively dismissing it. The Court ordered that a copy of the instructions be served on the applicant’s counsel and recorded the instructions as Appendix ‘A’.
