Allahabad High Court

DEEP CHANDversusMAYUR MAHESHWARI, CHIEF EXECUTIVE OFFICER UTTAR PRADESH STATE INDUSTRIAL DEVELOPMENT CORPORATION

Decided

Holding

The contempt application was dismissed as no case for contempt existed after the proceedings were dropped.

Summary

The petitioner, Deep Chand, filed a contempt application after a prior writ petition (Writ-A No. 6942 of 2024) concerning an inquiry against him. The opposite party, represented by the CEO of Uttar Pradesh State Industrial Development Corporation, filed a compliance affidavit indicating that an inquiry report had been submitted on 10 May 2024 and that the competent authority would decide within two months. Subsequently, the court noted that the authority had taken a decision on 1 May 2026, dropping the proceedings against the petitioner. The court held that, since the underlying proceedings were dismissed, there was no basis for a contempt proceeding. Accordingly, the contempt application was dismissed and the contempt notice discharged.
