Allahabad High Court

LAXMI KANT SINGHversusSHRI RAJEEV KUMAR SINGH, CONSOLIDATION OFFICER, PHOOLPUR

Decided

Holding

A prima facie case of contempt exists, but the court refrains from issuing notice and instead grants time for compliance, disposing the contempt application at this stage.

Summary

Laxmi Kant Singh filed a contempt application against Rajeev Kumar Singh, a Consolidation Officer, alleging willful defiance of a High Court order dated 06‑12‑2024 in Writ B No.4286 of 2024. The court noted that a certified copy of the order had been served but the opposite party had not complied. While it found a prima facie case of contempt, the court declined to issue a notice and instead granted the opposite party six weeks to comply with the writ order. The court directed the applicant to provide stamped envelopes for service of the order and set a timeline for the opposite party to comply and inform the applicant. The application was disposed without further proceedings, leaving open the possibility of a fresh application if compliance is not achieved.

Issues considered

  • Whether the opposite party's failure to comply with the writ order amounts to contempt of court
  • Whether a notice is required before proceeding with contempt proceedings
  • What appropriate relief or direction the court should grant in a contempt application
