Allahabad High Court

MAHESH CHAND VERMA AND ANOTHERversusDR. SANJEEV GUPTA, ADDITIONAL DIRECTOR GENERAL OF POLICE

Decided

Holding

The court held that while a prima facie case of contempt exists, the opposite party was given two months to comply before any contempt proceedings could proceed.

Summary

The applicant filed a contempt application alleging that the opposite party willfully disobeyed the judgment and order dated 06.01.2026 in Writ A No. 19422 of 2025. The court noted that a prima facie case of contempt existed but, without issuing a notice, granted the opposite party an additional two months to comply with the order. The applicant was directed to provide stamped envelopes for service of the order, and the court ordered that the order be sent to the opposite party within a week of receipt. The opposite party was required to comply with the writ court's directions and inform the applicant within a week thereafter. The court held that if the opposite party fails to comply, the applicant may approach the court again, and the contempt application was disposed at this stage.
