The contempt application was disposed of, with the opposite party given six weeks to comply with the original order and no contempt finding made at this stage.
Summary
The applicant, Chetan Anand Bharti, filed a contempt application alleging that the opposite party, Sri Dr. Chandra Bhushan, willfully disobeyed the High Court's judgment dated 10 December 2025 in Writ‑A No.18610 of 2025. The order required the opposite party to comply with certain directions, which, according to the applicant, have not been fulfilled despite service of the order. The court examined whether a prima facie case of contempt existed and considered procedural requirements such as issuing notice. While it found a prima facie case, the court declined to issue a notice at this stage and instead granted the opposite party six weeks to comply. The court directed the applicant to provide stamped envelopes for service of the order and contempt application, and ordered that the opposite party must comply and inform the applicant within a stipulated period. If compliance is not achieved, the applicant may approach the court again. The contempt application was therefore disposed of without a contempt finding.
Issues considered
- Whether the opposite party's failure to comply with the order dated 10‑12‑2025 constitutes willful disobedience amounting to contempt of court.
- Whether notice should be issued to the opposite party before proceeding with contempt proceedings.
