Holding
The court did not find contempt and disposed of the contempt application, granting the opposite party additional time to comply with the earlier order.
Summary
The applicant filed a contempt application alleging that the opposite party had willfully failed to comply with an order dated 17-12-2025 issued in Writ C No. 44450/2025, which required the opposite party to decide a claim. The court examined the allegation, noted that a copy of the order had been served, but found that no notice had been issued to the opposite party before proceeding. Consequently, the court granted the opposite party an additional month to comply with the order, subject to the production of a certified copy and specific mailing instructions. The applicant was directed to provide stamped envelopes for service of the order and contempt application. The court warned that failure to comply would permit the applicant to approach the court again, and the contempt application was disposed of at this stage without finding contempt.
Issues considered
- Whether the opposite party is in contempt for alleged non‑compliance with the order dated 17‑12‑2025 in Writ C No. 44450/2025
- Whether notice and a further opportunity to comply are required before contempt can be established
Subjects
- contempt of court
- non‑compliance
- writ petition
- order enforcement
- procedural directions
