Allahabad High Court

SATYAM YADAVversusSAURABH VIJAY REGISTRAR GENERAL GOVT. OF INDIA MINISTRY AND ANOTHER

Decided

Holding

The court held that the contempt application should not proceed at this stage and instead gave the opposite party time to comply with the original order.

Summary

The applicant filed a contempt application alleging that the opposite party willfully disobeyed the High Court's order dated 05‑02‑2026 in Writ‑C No.46189 of 2025. The court examined whether the failure to comply amounted to contempt and whether notice was required before proceeding. It found a prima facie case of non‑compliance but chose not to issue notice at this stage. Instead, the court granted the opposite party two months to comply with the original order and directed the parties to exchange certified copies and self‑addressed envelopes. The court further directed that if compliance is not achieved, the applicant may approach the court again. The contempt application was therefore disposed of without further proceedings.

Issues considered

  • Does the opposite party's failure to comply with the order dated 05‑02‑2026 constitute contempt of court?
  • Is it necessary to issue notice to the opposite party before entertaining a contempt application?
