Allahabad High Court

MRITYUNJAY PRASAD GUPTAversusSATYENDRA SINGH AND 5 OTHERS

Decided

Holding

The contempt application was not proceeded against the opposite parties; instead, the court granted them a further four weeks to comply and disposed of the application at this stage.

Summary

The applicant, Mrityunjay Prasad Gupta, filed a contempt application alleging that the opposite parties willfully defied an order dated 12‑12‑2025 issued in Writ‑C No. 43927 of 2025. The court noted that despite service of a certified copy of the order, the opposite parties had not complied. While a prima facie case of contempt was acknowledged, the court declined to issue a notice at this stage and instead granted the opposite parties an additional four weeks to comply. The court directed the applicant to provide stamped envelopes for service of the order and contempt application, and ordered the court office to forward these to the opposite parties. The opposite parties were required to comply with the writ order and inform the applicant within a week thereafter. The court held that if compliance is not achieved, the applicant may approach the court again, and disposed of the contempt application for now.
