Allahabad High Court

SIMPU DEVIversusSHRI MAHENDRA SINGH TANWAR DISTRICT MAGISTRATE

Decided

Holding

The court held that, although a prima facie case of contempt exists, it will not proceed with contempt proceedings and instead granted the opposite party six weeks to comply with the order.

Summary

The applicant filed a contempt application alleging that the District Magistrate failed to comply with an order dated 06‑07‑2026 issued in Writ‑C No. 22936/2026 directing the opposite party to decide a claim. The court noted that a prima facie case of willful disobedience existed but declined to issue a notice at this stage. Instead, the court granted the opposite party six weeks from receipt of a certified copy of the order to comply, and directed the applicant to provide stamped envelopes for service. The opposite party must send the complied order to the applicant within a week of compliance, after which the applicant may approach the court again if compliance is not achieved. The contempt application was therefore disposed of pending further compliance.
