The court held that the contempt application is not dismissed but the respondent is given a further month to comply with the earlier order, with procedural steps for service, and no notice is issued at this stage.
Summary
The applicant, Chandrabhushan Singh, filed a contempt application alleging that the respondent, Tehsildar Yogendra Kumar Pandey, failed to comply with an order dated 27 April 2026 issued in PIL No. 1063 of 2026. The applicant claimed that a copy of the order had been served but no action was taken. The court found that a prima facie case of willful disobedience existed but declined to issue a notice at this stage. Instead, the court granted the respondent an additional month to comply, subject to the applicant providing stamped envelopes for service of the order. The court directed the office to forward the order and contempt application to the respondent and required the respondent to inform the applicant of compliance within a week thereafter. If compliance is not achieved, the applicant may approach the court again. The application was disposed of with these directions.
