Allahabad High Court

MAUN SINGHversusVIKAS YADAV, DIVISIONAL FOREST OFFICER JHANSI FOREST DIVISION JHANSI

Decided

Holding

The court held that although a prima facie case of contempt exists, it would not issue notice but instead grant further time for compliance and dispose of the application at this stage.

Summary

Maun Singh filed a contempt application against Divisional Forest Officer Vikas Yadav alleging failure to comply with the order dated 27‑02‑2026 passed in Writ‑A No. 3063 of 2026. The court noted that a prima facie case of willful disobedience existed but declined to issue a notice at this stage. Instead, it granted the opposite party two months from receipt of a certified copy to comply with the writ order. The court directed the applicant to provide stamped envelopes for service of the order and contempt application, and ordered the court office to forward them within a week. The opposite party was instructed to comply with the writ court’s directions and inform the applicant within a week thereafter. The court held that if compliance is not achieved, the applicant may approach the court again, and disposed of the contempt application for now.

Issues considered

  • Whether the opposite party is in contempt for willful non‑compliance of the writ order dated 27‑02‑2026
