Allahabad High Court

YOGENDRA SINGHversusSRI DEVASHISH JANA, DIVISIONAL FOREST OFFICER

Decided

Holding

The Court did not find contempt but gave the opposite party a further two months to comply with the earlier writ order.

Summary

Yogendra Singh filed a contempt application against Divisional Forest Officer Devashish Jana alleging willful non‑compliance of an order dated 20‑05‑2026 passed in Writ‑A No. 7661 of 2026. The Court noted that a prima facie case of contempt existed but refrained from issuing a notice at this stage. Instead, it granted the opposite party two months to comply with the original order and directed the applicant to provide stamped envelopes for service of the order and contempt application. The opposite party was ordered to send a copy of the complied order to the applicant within a week of compliance. The Court held that if the opposite party fails to comply, the applicant may approach the Court again, and the contempt application was disposed of for the time being.

Issues considered

  • Whether the opposite party is in contempt for wilful non‑compliance of the order dated 20‑05‑2026.
  • Whether notice of contempt should be issued at this stage.
  • What procedural directions are appropriate to enforce compliance with the writ order?
