Allahabad High Court

PRAVEEN KUMARversusSRI RAJNISH CHANDRA (OFFICIATING) DIRECTOR SOCIAL WELFARE DEPARTMENT

Decided

Holding

Because the opposite party complied with the writ court's order, no contempt of court arose and the contempt application was dismissed.

Summary

The High Court, while disposing of Writ‑C No. 12392 of 2025 on 23 April 2025, directed the opposite party to decide the applicant's representation if a representation was filed. The opposite party filed an affidavit on 12 February 2026 stating that it had complied with the order and had decided the representation on 2 February 2026, attaching the decision as annexure. The applicant then moved a contempt application alleging non‑compliance. The Court examined whether the failure to decide representation, as alleged, amounted to contempt of its earlier order. Finding that the affidavit demonstrated full compliance, the Court held that no contempt had occurred, dismissed the contempt application and discharged the contempt notice.

Issues considered

  • Whether the opposite party's alleged failure to decide the applicant's representation amounted to contempt of the High Court's order.
  • Whether compliance with the earlier writ order negates the existence of contempt.
