Allahabad High Court

MANJU GUPTAversusYADAV S. THAKUR

Decided

Holding

A prima facie case of contempt exists, but the court refrains from issuing notice and instead grants time for compliance.

Summary

Manju Gupta filed a contempt application against Yadav S. Thakur alleging willful defiance of an order dated 24 April 2026 issued in Writ‑A No. 5930 of 2026. The applicant claimed that despite service of a certified copy, the opposite party had not complied with the writ court's directions. The High Court observed that a prima facie case of contempt existed but declined to issue a notice at this stage. Instead, the court granted the opposite party an additional four months to comply, subject to procedural steps involving stamped envelopes and self‑addressed envelopes. The court directed that if compliance is not achieved, the applicant may approach the court again, and the contempt application was disposed of pending further compliance.

Issues considered

  • Whether the opposite party willfully disobeyed the order dated 24‑04‑2026 in Writ‑A No. 5930 of 2026.
  • Whether contempt proceedings should be initiated against the opposite party at this juncture.
