Holding
The court found a prima facie case of contempt but deferred notice, granting the opposite party time to comply and disposing of the application pending compliance.
Summary
Dr Manas Sharan Tiwari filed a contempt application against Dr Ajeet Kumar, District Inspector of Schools, alleging willful defiance of an order dated 18‑11‑2025 issued in Writ‑A No. 17290 of 2025. The applicant claimed that despite service of a certified copy, the opposite party had not complied with the writ court’s directions. The High Court observed that a prima facie case of contempt existed but chose not to issue a notice at this stage. Instead, the court granted the opposite party an additional three months to comply and directed the applicant to provide stamped envelopes for service of the order. The court further ordered that the opposite party must comply with the writ court’s directions and inform the applicant within a week of compliance, and left open the possibility of a fresh application if compliance fails. The contempt application was therefore disposed of pending compliance.
