Allahabad High Court

RAM GOPAL SHARMAversusMR. PRADEEP SINGH BAGHEL, DIRECTOR OF EDUCATION (SECONDARY)

Decided

Holding

The court declined to issue a notice, granted three months for compliance, and disposed of the contempt application pending compliance.

Summary

The applicant, Ram Gopal Sharma, filed a contempt application alleging that the opposite party, Mr. Pradeep Singh Baghel, had willfully failed to comply with an order dated 19‑01‑2026 issued in Writ‑A No. 6120/2026 directing the opposite party to decide a claim. The court examined the allegation and found that a prima facie case of contempt existed but noted that no notice had been issued to the opposite party. Consequently, the court granted the opposite party an additional three months from the production of a certified copy of the order to comply, and directed the applicant to provide stamped envelopes for service of the order. The court also ordered that the opposite party must inform the applicant of compliance within a week of receiving the order. If the opposite party fails to comply, the applicant may approach the court again. The contempt application was therefore disposed of pending compliance.

  • Whether the opposite party should be granted additional time to comply with the earlier writ order
