Allahabad High Court

VINOD KUMAR AND 6 OTHERSversusSRI ASOK KUMAR SINGH

Decided

Holding

The court declined to issue notice and instead granted the opposite party a further three‑month period to comply, disposing of the contempt application at this stage.

Summary

The applicants filed a contempt application alleging that the opposite party willfully disobeyed the judgment and order dated 06‑02‑2026 in Writ‑A No. 1756 of 2026. The order required the opposite party to comply with directions of the writ court, but the applicants claim no compliance has occurred despite service of the order. The court examined whether a contempt proceeding should be initiated at this stage. It held that while a prima facie case exists, no notice to the opposite party would be issued; instead, the opposite party was granted an additional three‑month period to comply after receipt of a certified copy of the order. The court also directed the applicants to provide stamped envelopes for service of the order and contempt application. If the opposite party fails to comply, the applicants may approach the court again. The contempt application was therefore disposed of pending compliance.

Issues considered

  • Whether the opposite party's failure to comply with the order dated 06‑02‑2026 amounts to contempt warranting immediate proceedings
