Allahabad High Court

MOHAMMAD ABU SUFIYANversusSMT. ANJANA SIROHI, REGISTRAR, U.P. MADARSA SHIKSHA PARISHAD

Decided

Holding

The court held that while a prima facie case of contempt exists, the opposite party should be given six weeks to comply before any contempt proceedings can proceed.

Summary

The applicant filed a contempt application alleging that the opposite party willfully disobeyed the High Court's judgment and order dated 17 September 2025 in Writ‑A No.13886 of 2025. The court noted that a prima facie case of contempt existed but, instead of issuing a notice, it granted the opposite party six weeks from receipt of a certified copy of the order to comply. The applicant was directed to provide stamped envelopes for service of the order, and the court ordered that the opposite party must inform the applicant of compliance within a week thereafter. If the opposite party fails to comply, the applicant may approach the court again. The contempt application was therefore disposed of pending compliance.
