Holding
The court held that the contempt application will not proceed at this stage and the opposite party is given a further three months to comply with the order, with service to be effected as directed.
Summary
The applicant filed a contempt application alleging that the opposite party willfully disobeyed the judgment and order dated 21‑04‑2026 in Civil Misc. Writ Petition No. 41374 of 2025. The court examined whether the alleged non‑compliance amounted to contempt and whether notice was required before proceeding. It found a prima facie case of contempt but, instead of issuing notice, the court granted the opposite party an additional three months to comply with the order. The applicant was directed to provide stamped envelopes for service of the order and contempt application. The opposite party must comply with the writ court’s directions and inform the applicant within a week of compliance. If the opposite party fails to comply, the applicant may approach the court again. The contempt application was therefore disposed of at this stage.
Issues considered
- Does the opposite party's failure to comply with the order dated 21‑04‑2026 constitute contempt of court?
- Is it necessary to issue a notice to the opposite party before proceeding with a contempt application?
