Allahabad High Court
OM VEER SINGH AND 5 OTHERSversusSANJAY PRASAD AND ANOTHER
- Decided
- Bench
- VIKAS BUDHWAR
Holding
The Court held that the High Court order had been complied with and therefore no contempt had occurred.
Summary
Six Sub‑Inspectors (Om Veer Singh and five others) filed a contempt petition alleging that the respondent, the Additional Chief Secretary (Home), willfully defied a High Court order dated 2 December 2025 which directed the Deputy Inspector General of Police to decide their claim for an additional salary increment after 19 years of service, including the training period, within two months. The Court examined communications from the Special Secretary and other officials showing that the order had been communicated, that instructions were issued to the Police Establishment, and that steps were taken to implement the increment. The Court found that the required compliance had been effected and that there was no refusal or neglect by the respondent. Accordingly, the Court held that the alleged contempt did not exist. The contempt application was therefore consigned to the record and dismissed.
Issues considered
- Whether the respondent willfully defied the High Court order dated 2 December 2025.
- Whether the steps taken by the Police Establishment constitute compliance with the order.
- Whether the circumstances amount to contempt of court under the Contempt of Courts Act.
