Allahabad High Court
RAM JATAN MAURYAversusSADANAND GUPTA, DISTRICT MAGISTRATE
- Decided

Holding
The court held that while a prima facie case of contempt exists, the opposite party should be given a further twelve weeks to comply before any contempt proceedings are pursued.
Summary
The applicant filed a contempt application alleging that the opposite party, the District Magistrate, willfully disobeyed the High Court's judgment dated 14 January 2026 in Civil Misc. Writ-(C) No.14576 of 2025. The court noted that a prima facie case of contempt existed but declined to issue a notice at this stage. Instead, the court granted the opposite party twelve weeks to comply with the original order upon receipt of a certified copy. The applicant was directed to provide stamped envelopes for service of the order, and the opposite party was instructed to comply and inform the applicant within a week thereafter. The court held that if compliance is not achieved, the applicant may approach the court again, and the contempt application was disposed of pending compliance.
