Allahabad High Court

COMMITTEE OF MANAGEMENT, GYAN PRAKASH INTER COLLEGE AND ANOTHERversusSRI DINESH SINGH

Decided

Holding

While a prima facie case of contempt was found, the court disposed of the application, granting the opposite party four weeks to comply with the writ order before any contempt proceedings are pursued.

Summary

The Committee of Management of Gyan Prakash Inter College filed a contempt application alleging that Sri Dinesh Singh willfully defied the order dated 11‑05‑2026 issued in Writ‑C No.41018 of 2025. The applicant claimed that despite service of a certified copy, the opposite party had not complied with the writ court’s directions. The High Court observed that a prima facie case of contempt existed but refrained from issuing a notice, instead granting the opposite party an additional four weeks to comply. The court directed the applicant to provide stamped envelopes for service of the order and required the opposite party to intimate compliance within a week of receipt. The court further held that if compliance is not achieved, the applicant may approach the court again, and disposed of the contempt application at this stage.

Issues considered

  • Whether the opposite party’s failure to comply with the order dated 11‑05‑2026 amounts to contempt of court.
  • Whether a notice should be issued before proceeding with contempt proceedings.
  • What procedural steps are appropriate to enforce compliance with the writ order.

Subjects

  • contempt of court
  • willful disobedience
  • writ order compliance
  • high court procedure
  • civil contempt
