Allahabad High Court

SMT SUNITA PANDEYversusDR UPASANA RANI VERMA

Decided

Holding

The court found a prima facie case of contempt but, without issuing notice, granted the opposite party additional time to comply and disposed of the contempt application at this stage.

Summary

Smt. Sunita Pandey filed a contempt application alleging that Dr. Upasana Rani Verma failed to comply with the order dated 25‑05‑2026 in Writ A No. 8049/2026, which directed the opposite party to decide a claim. The applicant claimed that a copy of the order had been served but no compliance had occurred. The court observed that a prima facie case of willful disobedience existed, but it declined to issue a notice at this stage. Instead, the court granted the opposite party an additional two months to comply, directing the applicant to provide stamped envelopes for service of the order and contempt application. The court ordered that the opposite party must comply with the writ court’s directions and inform the applicant within a week of compliance, and disposed of the contempt application pending further compliance.

Issues considered

  • What is the appropriate procedure for entertaining a contempt application when the alleged contemnor has not been given notice?
  • Whether the opposite party’s failure to comply with the writ order amounts to contempt of court.
