Allahabad High Court
COMMITTEE OF MANAGEMENT, SRI DURGA INTER COLLEGE KHUTAHIversusBANSH NARAYAN SINGH
- Decided
Holding
The review application is not maintainable and is dismissed.
Summary
The Committee of Management of Sri Durga Inter College filed a review application challenging an order dated 18‑02‑2026 that had been upheld by a Division Bench. The order had previously been affirmed by a Special Appeal (No. 307 of 2026) dismissed on 18‑03‑2026 on merit. The applicant argued that the earlier dismissal was not on merit and sought a review without having obtained permission from the Division Bench. The court examined whether a review is maintainable when the earlier order has already been affirmed and no permission was granted. Finding no legal basis to entertain the review, the court dismissed the application and imposed a cost of Rs. 1,000.

Court No. - 32
HON'BLE SAURABH SHYAM SHAMSHERY, J.
1. Heard Sri P.P. Chaudhary, learned counsel for review-applicant and Sri
Adarsh Singh, Advocate for writ petitioner.
2. The order under review dated 18.02.2026 was challenged at the behest
of review applicant by filing Special Appeal No. 307 of 2026, which was
dismissed vide order dated 18.03.2026 on merit. Now review applicant
has filed present review application to review the order dated 18.02.2026
which has already been upheld by a Division Bench by a reasoned order.
No permission was sought or granted by Division Bench to file review
application.
3. Therefore, the first question is, whether present review application is
maintainable or not.
4. The submission of learned counsel for review applicant that order dated
18.03.2026 is not on merit, therefore, he has filed review application, is
absolutely incorrect and the impression carried out by learned counsel for
review applicant is absolutely wrong.

5. I, therefore, find no reason to entertain this review application. It is
accordingly dismissed with cost of Rs. 1000/- to be deposited in the Bank
account of High Court Bar Association, Allahabad.
