Allahabad High Court
ASHOK PUNJABIversusSTATE OF U.P.
- Decided
- Bench
- CHAWAN PRAKASH
Holding
An appeal is abated and dismissed when the sole appellant dies.
Summary
The appellant, Ashok Punjabi, filed a criminal appeal before the Allahabad High Court. During the pendency of the appeal, the appellant died in 2021, as evidenced by a police report, statements of his wife and others, and a death certificate. The court considered whether the appeal could continue after the death of the sole appellant. It held that the death of the sole appellant results in abatement of the appeal. Consequently, the appeal was dismissed as abated and the trial court record, if summoned, was to be sent back. The file was consigned to the record.
