Allahabad High Court

ANKU SHAKYAversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The appeal is dismissed as infructuous.

Summary

The appellant Anku Shakya was charged under IPC sections 376(1) and 506, the POCSO Act sections 3 and 4, and the SC/ST (Prevention of Atrocities) Act sections 3(2)(5) and 14A(2). The Additional District & Sessions Judge denied bail in Bail Application No. 421 of 2017. The appellant filed a criminal appeal under Section 14A(2) of the SC/ST Act seeking to set aside that order and obtain bail. Counsel argued that the trial had already concluded, rendering the appeal moot. The High Court held that since the substantive trial was over, the appeal could not be entertained and dismissed it as infructuous. Consequently, the appeal was dismissed and any pending applications were disposed of.

Issues considered

  • Whether an appeal under Section 14A(2) of the SC/ST (Prevention of Atrocities) Act is maintainable after the trial has concluded
  • Whether the appeal is infructuous and should be dismissed
