Allahabad High Court

ANAND RAJ SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The appeal was dismissed for want of prosecution due to the appellant’s lack of representation.

Summary

Anand Raj Singh appealed to the Allahabad High Court under Section 14-A(2) of the SC/ST (Prevention of Atrocities) Act, seeking to set aside an order that rejected his anticipatory bail in a case involving multiple IPC offences and a provision of the SC/ST Act. The appeal listed two counsels for the appellant, but none appeared before the court to argue the application for bail. The State’s counsel was present. Since the appellant was not represented, the court dismissed the appeal for want of prosecution. No substantive consideration of the merits of the anticipatory bail request was made. The dismissal was recorded on May 6, 2026.

Issues considered

  • Whether an appeal under Section 14-A(2) of the SC/ST Act can proceed in the absence of any representation by the appellant.
