Allahabad High Court

POOJA CHATURVEDIversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The appeal is dismissed as it lacks legal force and the cognizance order is upheld.

Summary

The appellant, Pooza Chaturvedi, was alleged to have entrapped the complainant, Govind Diwakar, in a honey‑trap scheme to extort money, subsequently threatening and assaulting his family members and making casteist remarks. An FIR was lodged by the complainant under various provisions of the SC/ST (Prevention of Atrocities) Act and the BNS, leading to a charge‑sheet and cognizance by a Special Judge. The appellant filed a counter‑FIR against the complainant, which the investigating officer found to disclose no offence. The appellant appealed the cognizance order and the charge‑sheet, claiming procedural irregularities. The High Court examined whether the trial court’s cognizance and the charge‑sheet were legally valid and found no illegality or irregularity. Consequently, the Court held that the appeal lacked legal force and dismissed it.

Issues considered

  • Whether the cognizance order dated 06.04.2026 was vitiated by any illegality or irregularity.
  • Whether the charge‑sheet filed against the appellant was proper under the SC/ST Act and the BNS.
  • Whether the appellant’s counter‑FIR and pending protest petition affect the validity of the original proceedings.
