Allahabad High Court
RAJUDEEN @ RAJU AND 2 OTHERSversusSTATE OF UTTAR PRADESH AND 2 OTHERS
- Decided
Holding
The Court dismissed the writ petition for want of prosecution and discharged the interim order.
Summary
The petitioners filed a criminal miscellaneous writ petition in the Allahabad High Court. The Court had earlier ordered them to deposit Rs 20,000 with the Mediation Centre, but they failed to comply. Despite this non‑compliance, the petitioners continued to enjoy the benefits of an interim order. The Court examined the mediation report and, noting the failure to deposit the required sum, declined to extend the interim relief. Consequently, the writ petition was dismissed for want of prosecution and the interim order was discharged.
Issues considered
- Whether the interim order should be extended when the petitioners have not complied with the Court’s order to deposit the prescribed sum with the Mediation Centre?
- Whether the writ petition can be dismissed for want of prosecution due to the petitioners’ non‑appearance and non‑compliance?
