Allahabad High Court
NARENDRA SINGH VERMAversusSTATE OF UP AND 4 OTHERS
- Decided
Holding
The petition is dismissed as the final investigation report has already been forwarded and there is no ground to keep the matter pending.
Summary
The petitioners filed a criminal miscellaneous writ petition seeking a mandamus directing the police to conduct a fair, impartial and expeditious investigation of an FIR dated 22-04-2026 and to produce the case diary and investigation records before the court. The State, represented by the learned A.G.A., informed the court that the final investigation report had already been forwarded to the concerned court on 31-05-2026. The petitioner's counsel, after hearing the State's submission, requested that the petition be disposed of with liberty to seek any other appropriate remedy. The bench considered the State's submission and the petitioner's request and found no justification to keep the matter pending. Consequently, the court dismissed the writ petition, granting the liberty sought by the petitioners.
Issues considered
- Whether the High Court should issue a mandamus directing the police to conduct a fresh investigation of the FIR dated 22-04-2026
