Allahabad High Court
BILAL AHMAD AND 5 OTHERSversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
The FIR is quashed as the settlement between the parties removes any public interest in prosecuting the alleged offences.
Summary
The petitioners, Bilal Ahmad and five others, filed a writ petition seeking to quash an FIR dated 25‑05‑2025 that alleged offences under Sections 498A, 323, 504, 506 IPC and Sections 3/4 of the Dowry Prohibition Act. The parties had earlier settled their marital dispute through a mediation‑conciliation process, executed a notarised divorce deed and a financial settlement involving demand drafts totaling Rs 7,00,000. Both the petitioners and the State respondents accepted the terms of the settlement and did not contest its validity. The High Court, after examining the settlement deed and noting that the parties would not pursue any further litigation, held that there was no public interest in continuing the criminal prosecution. Relying on the Supreme Court’s decision in Gian Singh v. State of Punjab (2012) 10 SCC 303, the Court allowed the writ petition and quashed the FIR.
Issues considered
- What is the appropriate judicial remedy when the parties to a criminal complaint have amicably settled the dispute?
- Does a settlement between the complainant and accused bar the continuation of criminal proceedings under the IPC and Dowry Prohibition Act?
