Allahabad High Court

SANVVARversusSTATE OF UTTAR PRADESH AND 3 OTHERS

Decided

Holding

The writ petition is dismissed as the charge-sheet has been filed and cognizance taken.

Summary

The petitioner, Sanvvar, filed a criminal miscellaneous writ petition challenging the proceedings against him by the State of Uttar Pradesh and three others. The respondents submitted that a charge-sheet had been filed and the trial court had taken cognizance of the offence. The learned Additional Government Advocate could not dispute this submission. The High Court, after noting that the charge-sheet was already filed and cognizance taken, dismissed the writ petition. The court indicated that the petitioner could seek appropriate remedies against the charge-sheet under the relevant provisions of the B.N.S.S.
