Allahabad High Court

RANG BAHADURversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The petition is dismissed as the final investigation report has already been forwarded.

Summary

The petitioner, Rang Bahadur, filed a criminal miscellaneous writ petition seeking a mandamus directing the investigating officer to conclude the investigation of FIR No. 245/2024 under several sections of the Indian Penal Code. The State, through the Additional Government Advocate, informed the Court that the investigation had already been completed and the final report was forwarded to the concerned court on 20‑03‑2025. The petitioner, after hearing the State’s submission, requested that the petition be disposed of, reserving the right to pursue any other remedy. The Court examined whether there was any justification to keep the petition pending given the final report’s submission. Finding no reason to entertain the writ, the Court disposed of the petition, granting the liberty sought by the petitioner. The order was pronounced by Judges Tarun Saxena and Chandra Dhari Singh on 8‑September‑2026.

Issues considered

  • Whether the High Court can issue a mandamus directing the investigating officer to conclude an investigation when the final report has already been submitted.
  • Whether the writ petition should be dismissed on the ground that the investigation is complete.
