Allahabad High Court

JYOTI TYAGIversusSTATE OF UP AND 3 OTHERS

Decided

Holding

The writ petition is dismissed as withdrawn, with liberty to file a fresh petition.

Summary

Jyoti Tyagi filed Criminal Miscellaneous Writ Petition No. 18144 of 2026 before the Allahabad High Court challenging actions of the State of Uttar Pradesh and three other respondents. No counsel appeared for the fourth respondent. During the hearing, the petitioner’s counsel, Gyanendra Prasad Mahant, announced that the petitioner no longer wished to pursue the present writ and sought to withdraw it, reserving the right to file a fresh petition with more detailed particulars. The State’s Additional Government Advocate (AGA) raised no objection to this request. The Court, after noting the withdrawal request, dismissed the writ petition as withdrawn, granting the petitioner liberty to file a new petition if desired, and ordered the return of any certified copies. The order was pronounced on 23 September 2026 by Judges Devendra Singh‑I and Rajiv Gupta.
