Allahabad High Court
MANVENDRA SINGHversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The writ petition is dismissed; no writ of certiorari or mandamus is granted.
Summary
Manvendra Singh filed a criminal miscellaneous writ petition seeking a certiorari to quash an FIR dated 20‑09‑2021 (Case Crime No. 434 of 2021) and a mandamus to restrain his arrest under IPC sections 419, 420, 467, 468, 471 and 120‑B. The State, through its Additional Government Advocate, informed the court that a charge‑sheet had already been filed on 18‑09‑2026. The petitioner, through counsel, requested that the petition be disposed of in view of this development. The Court, after hearing both sides, held that with the charge‑sheet already submitted there was no justification to keep the writ petition pending and consequently dismissed the petition without granting any relief.
Issues considered
- Whether the FIR dated 20‑09‑2021 can be quashed by a writ of certiorari.
- Whether a writ of mandamus can be issued to restrain the arrest of the petitioner pending the filing of a charge‑sheet.
- Whether the petition should be dismissed after the charge‑sheet has been filed.
