Allahabad High Court

ANJU VERMAversusSTATE OF UTTAR PRADESH AND 3 OTHERS

Decided

Holding

The petition is dismissed as withdrawn.

Summary

The petitioner, Anju Verma, filed a criminal miscellaneous writ petition seeking a mandamus directing the second respondent to complete the investigation of a cyber‑crime case (Crime No. 0042 of 2025) under Section 66‑D of the Information Technology Act, 2008. The State, through its Additional Government Advocate, informed the Court that the investigation had already been transferred to another police station. The petitioner’s counsel, acknowledging this development, requested that the petition be disposed of at this stage. After hearing both sides, the Court held that the petition could be treated as withdrawn. Consequently, the writ petition was dismissed as withdrawn. The order was pronounced by Judges Chandra Dhari Singh and Abdul Shahid on 30 September 2026.

Issues considered

  • Whether the High Court should issue a writ of mandamus directing the completion of the investigation under Section 66‑D of the IT Act, 2008.
  • Whether the petition can be dismissed as withdrawn in view of the State’s clarification and the petitioner’s request.
