Allahabad High Court

HARIHAR PRASADversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The court held that, since the investigation was completed, a charge sheet filed, and cognizance taken, the writ petition for mandamus could not be entertained.

Summary

Harihar Prasad filed a criminal miscellaneous writ petition seeking a mandamus directing the second respondent to order further investigation after his application on 5 January 2026. No counsel appeared for the petitioner, while the State's learned Additional Government Advocate informed the court that the statutory investigation had been completed, a charge sheet was filed, and cognizance was taken by the trial court on 18 June 2026. The court considered the petitioner's non‑appearance and the fact that the investigation was already concluded. It held that there was no basis to keep the writ petition pending and directed the petitioner to pursue any grievance through the appropriate legal channels. Consequently, the writ petition was disposed of.
