Allahabad High Court

MITHUN @ BHARAT AND 7 OTHERSversusSTATE OF UP AND 3 OTHERS

Decided

Holding

The Court did not quash the FIR or grant a mandamus but directed the police to follow the Arnesh Kumar arrest guidelines and Section 35(3) of the B.N.S.S.

Summary

Petitioners filed a criminal miscellaneous writ petition seeking the quash of FIR No. 0245 of 2026 (sections 191(2), 115(2), 352 of the B.N.S.) and a mandamus directing the police not to arrest them. The petitioners later made an innocuous prayer that the police follow the Supreme Court guidelines laid down in Arnesh Kumar v. State of Bihar (2014) 8 SCC 273. The learned Additional Government Advocate opposed the merits of the petition but raised no objection to the innocuous prayer. The Court, after hearing both sides, allowed the innocuous prayer and directed the authorities to adhere to the Arnesh Kumar guidelines and Section 35(3) of the B.N.S.S. The petition was disposed without granting the reliefs of quashing the FIR or issuing a mandamus.

Issues considered

  • Whether the FIR dated 29.06.2026 under sections 191(2), 115(2), 352 of the B.N.S. can be quashed.
  • Whether a writ of mandamus can be issued directing the police not to arrest the petitioners.
