Allahabad High Court
CHANDRAJEET YADAVversusSTATE OF U.P. AND 6 OTHERS
- Decided
Holding
The petition is disposed as there is no ground to continue after the charge sheet has been filed.
Summary
Petitioner Chandrajeet Yadav filed a writ petition seeking a mandamus directing the police to complete the investigation of an FIR dated 25.09.2025 and to arrest accused persons. The State argued that the investigation was completed and a charge sheet had been filed only against one accused, with the others exonerated. The petitioner, after hearing the State's submission, requested that the petition be disposed. The Court considered that the charge sheet had already been forwarded to the trial court and found no reason to keep the writ petition pending. Consequently, the Court disposed of the petition without further adjudication.
Issues considered
- Whether the High Court can issue a writ of mandamus directing the police to conclude investigation and arrest when a charge sheet has already been filed
- Whether the writ petition remains maintainable after the charge sheet has been submitted
