Allahabad High Court

RAM CHANDRAversusSTATE OF UP AND 3 OTHERS

Decided

Holding

The writ petition is dismissed as there is no ground to continue the proceedings after the charge‑sheet has been filed.

Summary

The petitioner filed a criminal miscellaneous writ petition seeking a mandamus directing the police to conduct a fair, proper and impartial investigation in a case under Sections 74, 333, 115(2) BN.S. 2023 and Sections 7 and 8 of the POCSO Act. The State, through the Additional Advocate General, informed the Court that the charge‑sheet had already been filed on 07‑07‑2026. The petitioner, after hearing this submission, requested that the petition be disposed of. The Court examined the material and, noting that the charge‑sheet was already submitted and the petitioner had no further grievance, found no reason to keep the matter pending. Consequently, the writ petition was dismissed.

Issues considered

  • Whether a writ of mandamus can be issued directing the police to investigate when a charge‑sheet has already been filed.
  • Whether the writ petition remains maintainable after the completion of investigation and filing of charge‑sheet.
