Allahabad High Court
NISHA AND 4 OTHERSversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The Court directed the authorities to ensure that any arrest of the petitioners complies with the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar and Section 35(3) of the B.N.S.S, and disposed of the petition.
Summary
The petitioners, Nisha and four others, filed a writ petition seeking the quash of an FIR dated 02‑09‑2026 under IPC sections 351(2), 49 and 303(2) and protection from arrest. They also prayed that the police follow the arrest guidelines laid down by the Supreme Court in Arnesh Kumar v. State of Bihar before making any arrest. The State opposed the petition on merits but did not object to the innocuous prayer regarding the arrest procedure. The Court, after hearing counsel for both sides, allowed the innocuous prayer and directed the authorities to ensure that any arrest complies with the Arnesh Kumar guidelines and Section 35(3) of the B.N.S.S. The writ petition was disposed with this direction, without ordering the FIR to be quashed.
Issues considered
- Whether the High Court can direct the police to follow the Arnesh Kumar guidelines before arresting the petitioners
