Allahabad High Court

ANOJ KUMARversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court did not quash the FIR or grant mandamus but directed the police to follow the arrest guidelines of Arnesh Kumar and Section 35(3) of the B.N.S.

Summary

Petitioner Anoj Kumar filed a criminal miscellaneous writ petition seeking quash of an FIR dated 14.07.2026 under Sections 318(4) and 351(3) of the B.N.S. and a mandamus restraining his arrest. The petitioner also prayed that the police follow the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar regarding arrest procedures. The State opposed the petition on merits but did not object to the innocuous prayer for compliance with the Arnesh Kumar guidelines. The Court, noting the lack of objection, allowed the innocuous prayer and directed the authorities to ensure any arrest is carried out in accordance with the Arnesh Kumar guidelines and Section 35(3) of the B.N.S. The petition was disposed with this direction, without quashing the FIR or issuing a mandamus.
