Allahabad High Court

RAHULversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The impugned interim maintenance orders do not suffer from any illegality and the criminal revision is dismissed.

Summary

Rahul filed a criminal revision challenging the Sessions Judge's order granting interim maintenance of Rs.4500 per month to the opposite party under Section 12 of the Protection of Women from Domestic Violence Act, 2005. The trial court had based the interim award on a prima facie assessment of Rahul's income, pending a full trial on the merits. The revisionist argued that the order was premature and should be set aside. The High Court examined whether the interim order was illegal or infirm and held that the trial court acted within its powers, as the interim award was permissible pending final adjudication. Consequently, the Court found no ground for interference and dismissed the revision.

Issues considered

  • Whether the interim maintenance order under Section 12 of the Protection of Women from Domestic Violence Act, 2005 can be set aside on revision.
  • Whether the trial court erred in granting interim maintenance without a full evidentiary hearing.
