The court ordered the revisionists to surrender within three weeks, stayed any arrest during that period, and disposed of the revision without adjudicating the discharge application.
Summary
The revisionists filed a criminal revision against the Additional Session Judge’s order rejecting their discharge application in a case involving offences under Sections 147, 149, 302/34, 307, 504 and 506 of the IPC. The petitioners did not wish to contest the merits and instead requested liberty to surrender and apply for bail. The High Court directed the revisionists to surrender before the trial court within three weeks and ordered that no arrest be made during that period. It further directed that any bail application filed after surrender be disposed of expeditiously in line with the Supreme Court’s guidelines in Satender Kumar Antil v. CBI. The court stayed any further arrest and disposed of the revision petition. The order effectively closed the revision without a substantive hearing on the discharge issue.
Issues considered
- Whether the revision petition seeking discharge can be entertained on its merits or may be disposed without hearing.
- Whether the court can direct the accused to surrender and stay arrest pending surrender.
- Whether bail applications filed after surrender must be decided in accordance with the Supreme Court guidelines in Satender Kumar Antil v. CBI.
