Allahabad High Court

PRASHANT KUMAR MEENAversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The revision petition is infructuous and must be dismissed because the charges have already been framed, leaving no matter for adjudication.

Summary

The petitioner, Prashant Kumar Meena, filed a criminal revision challenging the order of the Special Judge (DDA Act) dated 12 November 2025, which dismissed his application for discharge in a case under Sections 309(4) and 317(2) of the Delhi Development Authority Act. The petitioner argued that the order should be reviewed, but the High Court observed that after the impugned order the charges had already been framed, leaving no substantive issue for adjudication on the merits. Consequently, the Court held that the revision petition was infructuous. The petition was therefore dismissed without any further hearing on the merits. The decision was delivered by Justice Manoj Bajaj on 5 May 2026.

Issues considered

  • The revision petition is maintainable when the charges have already been framed after the order dismissing the discharge application.

Petitioner is aggrieved against the order dated 12.11.2025 passed by
Special Judge (DDA Act)/Additional Sessions Judge, Agra in Session
Case No.1124 of 2025, arising out of Case Crime No.73 of 2024, under

Learned counsel states that subsequent to the impugned order dated
