Allahabad High Court
SALMAN KHANversusSTATE OF U.P. AND ANOTHER
- Decided
Holding
The Court held that, on sufficient cause, a ten‑day delay in filing the revision may be condoned and the interim maintenance order can be modified to stay arrears until the pending Section 125 Cr.P.C. application is finally decided.
Summary
Salman Khan filed a criminal revision challenging an order of the Additional Principal Judge, Family Court, Jhansi dated 7 May 2026 which directed him to pay Rs 10,000 per month as interim maintenance to his wife, Saba Sultana, from 19 November 2025. He contended that the amount was not commensurate with his income, that no evidence had been produced, and sought a stay of the arrears pending the outcome of a pending application under Section 125 of the Criminal Procedure Code/Section 144 of the BNSS. The Court first considered a delay‑condonation application and, finding the affidavit satisfactory, allowed the condonation of a ten‑day delay in filing the revision. On the merits, the Court modified the impugned order, staying the arrears from 19 November 2025 to 6 May 2026, directing the revisionist to pay maintenance from the date of the order and directing the Family Court to dispose of the pending Section 125 application within six months. The revision was consequently disposed of with these directions.
Issues considered

- Whether the interim maintenance order dated 7 May 2026 can be modified to stay arrears pending adjudication of a pending Section 125 Cr.P.C./Section 144 BNSS application.
