Allahabad High Court

MUKESH KUMAR @ JAI SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The ex‑parte maintenance order dated 05‑07‑2025 is set aside subject to payment of arrears, with the trial court directed to accept arrears up to Rs 72,000 by November 2026 and to provide a hearing; failure to pay authorises execution and civil imprisonment.

Summary

Mukesh Kumar (Jai Singh) filed a criminal revision challenging an ex‑parte maintenance order dated 05‑07‑2025 that required him to pay Rs 3,000 per month to his wife without a hearing. He argued the order was passed without due process and that the revision was filed after a 341‑day delay. The revisionist had already paid Rs 21,000 and offered to clear any arrears up to November 2026. The High Court directed the Family Court to accept arrears of up to Rs 72,000 and to provide a hearing, while ordering execution of the maintenance order and possible civil imprisonment if arrears were not paid. The court also directed that any interim applications be decided within 60 days and that the Section 125 Cr.P.C./144 BNSS proceedings be concluded promptly. The revision was thereafter disposed of.

Issues considered

  • Whether an ex‑parte maintenance order passed without hearing can be set aside on revision.
  • Whether the 341‑day delay in filing the revision bars any relief.
  • Whether the revisionist is liable to pay arrears of maintenance and the consequences of non‑payment.
  • Whether the execution case under Section 147 BNSS can be quashed.
