Allahabad High Court

DEVRAJ PRAJAPATI AND 9 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court did not decide the merits but directed verification of the compromise by the trial court and disposed of the application.

Summary

The applicants filed an application under Section 528 of the B.N.S.S. seeking to quash the charge sheet dated 20‑04‑2025 and the cognizance order dated 14‑08‑2025 in Criminal Case No. 106309 of 2025, which involved offences under Sections 147, 323, 504, 506, 498‑A of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. The applicants claimed that the parties had amicably settled the dispute through a compromise dated 13‑02‑2026 and argued that continuation of the criminal proceedings would be an abuse of process. The State opposed the application, contending that the trial court alone must verify the existence and validity of the compromise before any order can be passed. The High Court, without expressing any view on the merits, directed both parties to appear before the trial court with the compromise deed for verification and ordered that no coercive action be taken pending such verification. The Court disposed of the application, leaving the matter to be decided by the trial court, and indicated that the applicants could approach the High Court again after verification for quashing the proceedings.

Issues considered

  • Whether a compromise between the accused and the complainant can be the basis for quashing a criminal charge sheet and cognizance order under Section 528 of the B.N.S.S.
  • Whether the trial court must first verify the authenticity and fulfillment of the compromise before any quash order can be granted

                                                                     2

correctness of the documents relied upon by him.

                                    6. Learned A.G.A., however, submits that it is the Trial Court, which has to
verify the fact as to whether the parties have entered into compromise, hence
the applicants may approach the concerned Court and move an application
with respect to compromise between the parties, which will be decided in
                                    accordance with law.

along with compromise deed as well certified copy of this order within three
weeks from today. It is expected that Court concerned may fix a date for the

pass an appropriate order with respect to the same in accordance with law, as
expeditiously as possible, after giving opportunity of hearing to both the
parties, preferably within a period of three months from the date of
production of a certified copy of this order, if there is no other legal
impediment. While passing the order verifying the compromise, the Court
concerned shall also record the statements of the parties as to whether all the

                                    have been fulfilled or not.

                                    8. The Court in that scenario will allow the parties to obtain certified copy of
the report as well as compromise and it will be open to the applicants to
